Data Protection

Of course your personal data will be treated confidentially according to the data protection legislation. The data will be used exclusively for individualised BMW Motorrad customer care purposes within BMW AG, by the BMW Motorrad dealers as well as by third parties required for processing the data.

General Conditions of Usage

  2. Eligibility for Registration

    All contractually capable persons aged over 18 may register and use the GPS Drawings application under these conditions of usage. These registered users are called “users” in the following.

  3. Purpose of the Application

    The GPS application is meant as a community platform for motorbike riders. The platform allows to show and share motorbike rides by GPS data. Such rides may be commented or documented by the users with additional media data (such as text, photo, and film). The application also allows to plan rides online and download the resulting GPS data.

    Users are not allowed to use the application for commercial purposes, as for example to promote or advertise products and services.

    BMW takes no liability in the verity of statements conveyed by data which was supplied by users.

    BMW takes no liability in the correctness of downloaded GPS data, especially as far as its compliance with traffic rules are concerned.

    BMW takes no liability for direct or indirect damage of any kind resulting from the use of downloaded data.

  4. Submission of data (GPS, photo, image, video, and text data)

    1. Each user has a user profile which is stored in the GPS Drawings database. If the organiser believes a user has violated the conditions of usage, the rules of good taste or laws, the organiser may exclude this user from the application. The organiser is not obliged to justify the exclusion of users. The exclusion of users may take place without prior notice.

    2. Each user can upload GPS data files to be presented as drawings or tours. Each user may upload additional media data to illustrate or document his or her GPS drawings or tours.

      Submitting data is only possible via Internet. Entries submitted by any other means will neither be returned nor published in the application.

    3. The submitted data is labelled with the description supplied on upload (name of the file, description text) as well as linked to the user’s registration data. The data is then stored on the organiser’s server(s) under this information. Users hereby expressly agree to the use and storage of their data in this way.

    4. Data which does not comply with the technical requirements and the above conditions or which the organiser believes to violate the rules of good taste or contravene laws will be removed from the application (this especially includes data which is pornographic, politically incorrect or which glorifies violence). The organiser is not obliged to justify the exclusion of data from the application. There is no entitlement to publication. The removal of data may take place without prior notice.

  5. Copyright
    1. Copyright ownership

      The user assures that he or she is in possession of all rights for any data (GPS, photo, image, video, and text data) submitted and has unlimited exploitation rights for all parts of the data, that the data is free of any third-party rights and does not infringe personal rights in the depiction of individuals. If one or more persons are visibly depicted in the data, these persons must agree to the publication of the media. The user will provide written assurance of this on request. If third party claims are nonetheless asserted due to the infringement of such rights, the user exempts the organiser from all claims. Data processed on the computer may not contain any sections from other sources, e.g. magazines, books, purchased CDs etc.

    2. Assignment of rights

      Every user grants the organiser and its partners unlimited, non-exclusive rights in terms of space, time and content – including the rights to process the submitted data files for the competition, for reporting (regardless of which media, including print and online), for the PR of the GPS application, for exhibition posters, invitations, exhibitions, e-cards, screen savers, calendars, catalogues and books. If data is used for commercial purposes which go beyond the application e.g. for the manufacturing of merchandising products, the participant will be offered terms and conditions relating to this
